About two weeks after the bond hearing – during which the stalker remained in jail as he could not produce $10,000 cash – I got a call from the Victim’s Advocate in the court.  This is a woman who works in the Prosecuting Attorney’s office and, as her title indicates, acts as a liaison between the court and the victim.  She was the one truly competent, invested individual I encountered during my dealings with the court and has become a friend.

The stalker had plead ‘not guilty’ at the initial hearing, and he wanted to get out of jail until the jury trial which was scheduled for two months out. The Victim’s Advocate was calling to inform me that the stalker had, through his court-appointed attorney, requested a hearing to have his bond waived.  WAIVED. Seriously? I mean, even in Monopoly, unless you are lucky enough to draw a Get Out Of Jail Free card, you SIT THERE OR PAY TO LEAVE. Does the United States judicial system now hand out Get Out Of Jail Free cards upon request? Apparently so. Because the Victim’s Advocate urged me to appear in court and testify, stating that if I did not, it was very likely his request would be accepted by the judge.

I did not want to testify, but I thought, at the very least, it would be good practice for the jury trial and at best, could keep him in jail until the trial.  Mike took the day off and went with me, and I drenched myself in Golden Armor, which did its job – even though I was in a small room with the stalker and on the stand in front of him, I felt that he could not see me, could not access me.  He was in an orange jumpsuit, chains shackled around his ankles and wrists cuffed to a chain around his waist.

I took the stand first, and the Prosecuting Attorney asked me questions that allowed me to describe the history of the stalking and the measures taken to try to stop it.  He ended with the question, “Do you think the bond should be waived?”  I said, “No.  When I told him to stop, he said he would stop but he didn’t; it escalated.  When the Chief of Police called him and told him to stop, he said he would stop but he didn’t; it escalated further.  He says he will stop now but there is nothing in his past behavior to indicate that he will stop if he is released, in fact, the pattern shows the opposite.  I hope the court recognizes this and will hold him accountable for his actions.”

I was told to remain on the stand because it was now the defense attorney’s turn to question me.  The court-appointed defense attorney was a misogynistic incarnation of evil.  God, she was vile.  SHE.  And not just with me.  She defends rapists, abusers, and stalkers, and I heard much about her treatment of other female victims – her attempts to blatantly humiliate and denigrate victims while they’re on the stand – and that she was chronically rude and unprofessional to the staff of the county attorney’s office.

When she had her chance with me, she tried.  Oh, how she tried to slander my character and upset me.  But it soon became evident to everyone in the room that she was no match for me. I wanted to say, “Lady, don’t waste your time. I BLOG.  The worst you’ve got won’t come close to the hatemail I’ve gotten. The trolls have made me immune.

She became visibly filled with hatred because I didn’t crack under her words.  And her defense was ludicrous.  Here’s an example:
Her:  Have you read anything by Stephen King?
Me:  No.
Her:  {accusatory tone}  What??
Me:  No.
Her:  {pause}  Well, you know who he is?
Me:  Yes.
Her:  {sing-song voice}  My client is creative.  He wants to be a writer.  Say he was just acting this way as research for a novel he’s working on.  There’s no law against that, is there?
Me:  Yes, there is.  That’s why he was ARRESTED.

So, by her logic, it’s OK to kill someone, as long as you write a book about it afterward?  Idiot.

Then it was the stalker’s turn to take the stand.  The defense attorney made a big fuss about how I had accepted his “friend request” on Facebook, nevermind that I’ve accepted over 3,000 friend requests, that it happened months before the stalking began, and that I had since blocked him.  That, and the “he’s the next Stephen King,” were their only defense.

When it was the Prosecuting Attorney’s chance to question the defendant, he asked, among other things, why the stalker had a loaded .44 Magnum with him.  The stalker launched into a long, detailed, disturbing monologue about how he had creditors after him.  The creditors would not leave him alone.  And so he carried a loaded gun at all times because if those creditors got close he was going to shoot the first one in the face, and the last thing the second one was going to see was the bullet exiting the giant hole in the back of his partner’s head and the blood splattering all over right before it then entered his brain.  He was going to kill both those creditors with one bullet.  And then those creditors wouldn’t be bothering him anymore.

The courtroom was silent.  The judge had his jaw on the desk in front of him.  You could see the defense attorney saying “SHUT UP! SHUT UP!” in her head.  The Prosecuting Attorney told me afterward that the hair on the back of his neck was standing on end.

The judge made his declaration.  He was red in the face and said, directly to the stalker, “You are crazy, you are dangerous, and bail stands at $10,000.”

    That post is ridiculously creepy– I was starting to see red imagining being there and hearing that psycho say such horrible things. What a nightmare. There is nothing more frustrating than seeing such injustice and the system failing to protect you. Take care!

    I am so sorry Shreve. How in the world is it that after a testimony like that there’s still more to the story. It certainly gave me chills.

    That said, you should be proud of the fact that you had the courage to testify against this lunatic. Standing up to anyone who is threatening you is not easy. Bravo!

    First, I wanted to punch the idiot defense attorney. Then, my jaw dropped reading how the stalker defended carrying his gun….I kept thinking “oh, my God! He is insane!” Thank the Lord that the judge denied his request. How you are staying strong through this is amazing – please take care!

    Shreve I am so concerned about this. for you!

    A few weeks ago we had a “credible” threat made against our building by someone looking to purchase health insurance. It has made all of us girls nervous to say the least. Since our ONE guard comes in at noon and is about 50 and out of shape. We are only on the third floor. And the only way out is the stairs that run out the front of the building. Oh. And we continue to have lobby “hours”
    They caught the guy.. speeding.. on his way to the city I work in. with a gun in his car… un registered. Needless to say non of us now want to go to the lobby. And even more of us are looking for new jobs.

    The crazies are out there. EVERYWHERE. I pray. And I dont do that often. That this guy is put away. And for your continued safety.

    where he’d get a very stiff punch in the face.

    I was hoping the judge would have INCREASED the bail after hearing from the guy. $10,000 just doesn’t seem like much. Don’t you get at least that much by having a AAA membership?

    Wow, Shreve, reading the newest post on this subject, I commend you on your bravery and intuition.

    You knew, or gained knowledge, of exactly what you needed to do to gain power over the situation and your fears – great job in exposing someone who is a danger to not just you but pretty much every human being that crosses his path.

    I think the exposition was brilliant. My question to you, without getting too personal, was: based on the previously sent obsessive/creepy/violent/disrespective emails from this person, did you expect that answer from him? Were you as surprised as everyone else? Are you going to discuss this in the next post?

    Thanks for sharing this experience! I’m sure that it is not the most pleasant writing that you’ve ever done…

    If he said that in court, isn’t that a real and actual death threat to “creditors” under oath? That is punishable, no? What about the days when you could request a sanity test under these circumstances? That person should be medicated and in a top security hospital for the criminally insane.

    Caria ~ I was a little surprised that he was “out of it” enough to say all of that on the stand, but not surprised at the content. The others were surprised at the content. Even Mike said, ‘wow, you knew this, you said this. but I didn’t realize it was this intense until now.’

    My god. After hearing that I would’ve upped the bond 100 fold. And WTF is up with the defense attorney?! She sounds as deranged as he is. Dangerous in an entirely different way. Glad you stood up to her.

    The behavior of the defense attorney and the stalker sound like one of the too many television dramas these days. It’s just so hard to believe that people are really this way! Come on people…EVOLVE!

    It seems like the public defender was grasping at straws from the very first word that came out of her mouth. She knew she was losing, because that comes off as nothing short of a *desperate* argument.

    You learned to shoot down the arguments with those tin cans! That’s an even better skill than shooting!

    I hope at least for the moment you’ve gained some safety and some peace of mind after all this.

    As for his “creditors” remark, I lost a family member a number of years ago to a similar crazy. She repossessed cars, and while she was trying to start the car she had come to get, the debtor came up behind her and shot her in the head at point-blank range. I hope he gets what’s coming to him.

    …Wow…just…wow. If someone seriously thinks they can score points with a judge to release bail by describing how he would kill someone, he’s sorely mistaken. They put people like this away for a reason.

    But, you said it yourself here, you’ve had all kinds of hate mail and trolls to deal with online.
    But, you also have the support of everyone around you as well. ^^

    Having these experiences once is bad enough, but having to write about them (with all the rereading, rephrasing and revisiting that competent writing requires) is a harrowing experience). I know that just the thought of having to sit down and record the experience in words is enough to make one crazy! It has to be done, but you have to be valiant to do it!     Thank God he let the batshit crazy stuff out on the stand. That’s just amazing that he hanged himself with his own words. After all the insults I’ve gotten from running a large website, I totally get what you mean by the trolls making you immune. It’s an amazing feeling when someone thinks they’re going to get under your skin, but you have power they don’t understand.

    Jeez. I don’t know which sounds more dangerous, an intelligent madman or a stupid madman. Probably the former, but both are pretty scary. This post gave me a more realistic sense of what you had to go through, of how you had to rally and I really gotta hand it to you for that perfect comeback – “That’s why he was ARRESTED.” Brilliant.

    I feel compelled to read these testaments about your experience but admit they do shake me to the core. My immediate feeling is of being alone, naked while the “protectors” with my clothing are dancing around prodding my aggressor with provoking absurd questions.     Gobsmacked.

    It’s bad enough that the process tried to shift blame for his actions onto you. If there was ever a textbook illustration of “but she asked for it!”, as if you somehow invited his vileness just by existing and living your life.

    The worst part, or at least the scariest to me, is that it might have worked. If he’d been just a little smoother, held it together on the stand just a little better, the process would have freed him to go on his merry way. They had to hear his explicit rants about shooting people in the face to take him as a serious threat.

    I’m so sorry you had to deal with this, Shreve, any of it. You learned how strong and by-god tough you really are but you should never have had to learn it that way.

    Hasn’t that freakshow defense attorney read Stephen King’s “Misery” or seen the movie adaptation?! Proved YOUR point, the Prosecutor’s point, the judge’s point… not the defense attorney’s! Apparently evil has fried her last remaining brain cell.

    I, too, am surprised they just sent this psycho back to jail. His gruesome testimony of what he’d do just to a lowly couple of creditors renders him the perfect candidate for Hannibal Lecter’s face mask and shackles and the most secure solitary confinement available.

    Shreve, you know it’s funny that a while back you commented that you’re loving all these kick-ass girl movies of late. I was told that when you admire something in someone else, it’s because you already possess that quality yourself. I can’t wait to see the new kick-ass girl movie SHREVE. The verbal disarming of that hair-brained defense attorney is almost messiah-like, as I imagine you doing that with the calmness of a deity. You are a class act.

    I am an attorney, and I have a case right now that is similiar to yours with respect to the people involved. The Good Folks, the Bad Folks, and the Evil Harpy Attorney. Encountering the latter two shakes my faith in the goodness of humanity. I have moments of despair in which I wonder why I try so hard to fight these people who seem to have endless energy for polluting the world.

Seriously, between the Stephen King defense and the stalker’s complete inability to even PRETEND to be sane (when he’s on the stand no less!), this whole thing screams CRAZY. I’m speechless.     First of all, I am so very sorry you have had to go through this Shreve.
    But I would like to point out that for everyone’s comments that “the system doesn’t work,” I have to disagree and say no, the system DOES work, and your story proves that point.
    Everyone here who is a regular reader (myself included) knows you are a person of integrity, but the legal system and the courts do not know anything about you. The premise is that everyone is treated equally under the law.
    And it is innocent until proven guilty. And yes, those who cannot afford an attorney get one appointed to them. The reason for this is that the accused is facing a loss of liberty.

    My reasons for saying the system worked in your case Shreve are as follows:
    1) everyone is entitled to an affordable bail, which means bail reduction hearings are allowed;
    2)As the named victim, you have rights, including the right to oppose release and be heard on that issue;
    3)The accused has a constitutional right to face their accuser, so as uncomfortable as it was for you to testify, it was also incredibly important;
    4)Because you showed up and contested bail reduction and release, the mental illness of your stalker was exposed, and the Judge did not grant release.
    That’s the system working the way it is supposed to.

    It’s amazing that this guy hasn’t been in trouble before, or that others weren’t aware of how pscyhotic he is. From what I read of your story, the guy is so far out of his mind that it’s criminal. My hope is for the guy to remain locked up. Unfortunately, due to the economy and lack of funding, many behaviorally ill and dangerous people are being released or allowed to remain on the streets like this guy. I’m so sorry this has happened to you. Stay safe!

    Wow, I’m sorry you’ve had to go through this and deal with such vile treatment. He’s really unattached to reality — he can’t even shut up to save himself. I’m so glad the judge (at least at this moment) saw that this made him a much more credible threat to you.

    Your description of the defense attorney reminded me of a wonderfully written book about how the criminal justice system handles violence against women. It’s called Our Guys by Bernard Lefkowitz, a journalist. It’s the story of the gang rape of a mentally disabled teen girl and the subsequent trial, where the defense attorneys used this same classic strategy: to make it seem like the woman wanted it and to discredit her in gendered ways.

    I’m too lazy to read 80+ comments, but the last time I checked, Stephen King just imagines what people would do in certain situations (or mostly that I read Full Dark, No Stars and he says just as much, at least according to the stories in that book). It’s already a weak argument either way!
    I will copy everyone elses sentiment, you’re very strong for facing all of this and being able to write about it for all the world to read.

    It amazes me that bail even has the possibility of being waived. You just wonder who the law is protecting. I’m so glad you’re ok and this man was caught. You’re a very strong woman, but this has been proven ten times over already :)
    This sort of reminds me of the documentary Dear Zachary. If you reeeeally want to get upset about bail procedures (and get hit by an emotional truck)I’d reccommend watching it.

    That the defense attorney would try to rationalize criminal behaviour (stalking and threatening) is just wow. She had nothing in her arsenal, obviously. Except arse, lots of arse.

    Geez, what I would have given to put Steven King on the stand directly after that cross. The stupidity, it burns.

    The defendant is obviously completely unhinged. I expect his life will come to no good end.

    This is the first of your blogs I have read. I went from goosebumps, to feeling physically ill, to tears. Thank goodness that you are as strong as you are. I am very concerned that we are more worried about the civil rights of the perpetrators of crime than we are of the victims. I moved to Montana to get away from the crazies, but am finding that they are everywhere and we can’t seen to do anything about it.Stay strong. You have emotional support out here in “Blog Land”.
    After reading your book, that was recommended by my 92 year old Aunt Bessie, I have become a fan of yours and Charlies. I also purchased the audio book so I can listen while I travel. I never get tired of hearing it!

    I am almost speechless (which doesn’t happen often). What a certifiable criminally insane madman. My first thought is… you poor thing. My second thought is he should be locked up and never see the light of day. My other thoughts are a combination of somehow knowing you are going to be fine. I have gathered based on your writings that you CAN handle yourself and hopefully will not have to prove so. My other thought is his lawyer is pure evil and should also be locked up. My stalker was my ex-husband and I helped ex-wife #3 put him in prison. But he is out now, free, somewhere….your strength inspires me, Shreve, as always thank you for sharing with us.

    For a horrible situation you handled it superbly; this particular part no less than the rest. Sounds like you threw the defender quite off her stride: she was not prepared to deal with someone as collected and strong as you.

    The stalker’s testimony was chilling, even on top of his previous behavior. At least it kept him from getting released at that point.

    Thank you for continuing to share this with us. I think writing this account out will serve you well, in the end. I for one find it at least as heartening as it is appalling. From the comments, that seems to be shared by a lot of your other readers.

    It’s a horrible story, and a hideous move by the defense attorney, but I can’t stop thinking that you can’t be rational with someone who has lost their mind. The trial doesn’t bring along reality for him, and the judge’s comments don’t help since he is obviously insane, and proably criminally insane.

    I hope he’s attended to appropriately and kept out of the general population while being treated for his mental illness. I HOPE he’s not still spillin’ out crazy all over the place.

    Holy crap! That’s crazy on a stick. Not that driving all the way to where ever the hell it is you actually live and all that other stuff he did wasn’t insane in the membrane. But there’s a few things you want to never say in court and musing about blood splatter and bullets are certainly a couple of them.

    And I wonder how that PD sleeps at night. I understand that the law provides for competent representation, but the Stephen King defense? Was she pissed that somebody already used Twinkies?

    As a judge, I am glad that at least that part of the legal system worked as it should. As to the defendant’s attorney, obviously she hasn’t been taught the best way to defend criminal cases. Of course, she had a case which appears to have had mothing worthwhile to defend with, so I guess she figured she had nothing to lose. Your postings, though, indicate this is normally the way she handles victims on the stand – and I say shame on her. She must have been absent when they taught professionalism 101. This is my first post – I have read your blogs for quite awhile and enjoyed everything. Keep up your target practice.

    I don’t know what the laws are regarding the right to carry, but they are fairly liberal about that here in Texas. I’d shoot that snake in a heartbeat and never give it another thought.     I’ve only just started reading you online and was appalled at your stalker experience; a malignancy from “civilization” infests a sagebrush paradise. The pervert is depressing enough, but add to him the shyster lawyer and a system that dispenses only legalities, not justice. A double-action revolver with .357 hollow-point magnums is an excellent tool; safe to handle,easy recoil, and effective stopping power.

    I pray you can soon put this creepy chapter in your life behind you. I just started reading your posts and I’m catching up on your goings-on.

    I wrote a another comment of a previous (similar) post but the comment did now show. But what keeps sticking out in this situation, for me, is the meaning of it all. If this were your movie, everything you come in contact with (supporting characters, events)is there for a reason. A lesson, An insight. Karma. It’s difficult to see it in this experience but I believe it applies in a “good” situation as well as a bad one.

    Have you thought about your stalker experience in this way? His actions seem to be the antithesis to what you desire and live by. Just my thoughts.

    As a longtime Stephen King fan, I almost laughed when I read that part. King has featured stalkers as villains more than once (if you ever want to check out one of his books, Rose Madder is one about a woman who’s stalked by her abusive husband), and he’s had some of his own, I believe–there’s a man out there who believes that King, not Mark David Chapman, shot John Lennon.

    (aka pwerer, aka ) is operated out of Ukraine and hires writers from countries like Jordan, Pakistan, India, and other places where $3-$7/page is considered an excellent wage. This wouldn’t be a problem if their writers actually knew how to speak (and write) fluent English, and if they didn’t institute a bunch of practices with the sole purpose of cheating their writers and their customers. Things being as they are, however, anyone that actually wants an academic quality paper written by a native (or at least fluent) English speaker should still well clear of this company.

    Not even close. I have never claimed to be the most talented anything in the world, and am certainly not the most talented writer.     There are two different types of reneerfces that employers will ask for: professional and personal. For the professional, they will want ref’s from people that can “vouch” for your character; someone from a previous employer, etc ..perhaps some of your clients would provide ref’s for you ( that should be acceptable, despite what you think ). Personal ref’s can be neighbors, members of the Church, etc, etc
